1. Introduction

Welcome to yanabooking.com (the “Website,” “Platform,” or “Service”). Yana (“we,” “us,” or “our”) operates the website. By accessing or using the Platform, you (“User,” “you,” or “your”) agree to these Terms of Service (“Terms”). If you do not agree to all of these Terms, you must not use the Platform.

These Terms incorporate by reference our Privacy Policy and any other written policies we post. We may update these Terms at any time by posting a revised version on the Platform. Your continued use constitutes acceptance of any changes.

2. What We Are — and What We Are Not

No Medical Care
Yana is not a health care or medical provider (“Provider”). We do not practice medicine, dentistry, or any other licensed health profession.
No Medical or Health Advice
Content on the Platform is provided for informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing a medical emergency, call 911 (or your local emergency services) immediately.
No Endorsement or Recommendation
We do not recommend or endorse any provider, treatment, product, device, or service. Any references to providers, treatments or services are for convenience and informational purposes only.
Independent Providers
Providers (clinics, hospitals, doctors, or other professionals) listed on the Platform or mentioned through our services are independent third parties. They are solely responsible for their own services, compliance with applicable laws/regulations, and billing. Yana has no control over the services they provide and disclaims any responsibility or liability related to their actions, omissions, or the clinical outcomes of treatments.

3. Services Provided — and Not Provided

What We Provide

Through the Platform, we offer features including:

Discovery tools to help you locate Providers.
Contact and communication channels between you and Providers to facilitate bookings or inquiries (when supported).
Facilitation of payments via independent third-party payment processors (where offered).

What We Do Not Provide

You understand that Yana does not provide:

Medical referrals, professional recommendations, or endorsements.
Medical advice, diagnosis, treatment, prescriptions, or any form of clinical care.
Any guarantee, warranty, or assurance of the quality, safety, or outcome of any treatment or service offered by a Provider.
Ongoing verification of Provider credentials, ranking by quality, or continuous monitoring of Providers or content.
Insurance, escrow, guarantee, or surety for services, payments, or outcomes.
Fee-splitting with Providers based on volume or value of referrals or services.

4. Eligibility

By using the Platform, you represent and warrant that:

You are at least 18 years old (or the age of majority in your jurisdiction) and have full legal capacity to enter into binding agreements.
Any information you provide during registration or booking is true, accurate, current, and complete.
You will maintain and promptly update your information to keep it accurate.

5. Accounts & Your Responsibilities

If you engage Yana on our Platform, you agree to:

Maintain confidentiality and accept responsibility for all activity under your account.
Not misrepresent your identity or affiliation.
Provide true, current, and complete information as required by the engagement process.

6. User Content, Reviews & Conduct

You may submit content to the Platform, including comments, messages, photos, or videos (“User Content”). By submitting User Content you grant Yana a non-exclusive, worldwide, perpetual, royalty-free, transferable license to host, reproduce, distribute, display, and create derivative works of your User Content.

You agree not to submit User Content that is defamatory, false, misleading, obscene, hateful, harassing, or illegal; that violates intellectual property rights; or that constitutes spam, fake reviews, or paid/promotional content disguised as independent reviews.

7. Data Protection & Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose personal information. By using the Platform, you consent to such collection, use, storage, and disclosure in accordance with the Privacy Policy.

When you provide health-related information or other sensitive details to contact or book with a Provider, you understand that Yana is not acting as a health care provider, medical record holder, or medical data custodian. It is solely your choice to share such information with Providers and with Yana, who are responsible for compliance with any applicable privacy or medical-privacy laws.

8. Payments & Third-Party Processors (If Applicable)

Where the Platform offers payment facilitation (e.g., deposits, booking fees), such payments will be processed by independent third-party payment processors. Yana does not store complete payment card data. The terms, security, and compliance obligations of the payment processors apply. Any disputes related to payment processing, card chargebacks, or refunds should generally be addressed with the payment processor.

Yana does not guarantee any refund, credit, or outcome related to services booked through Providers. All financial terms (prices, deposits, cancellation fees, refunds, etc.) are determined by Providers, unless expressly stated otherwise on the Platform.

9. Third-Party Links & Services

The Platform may contain links or references to third-party websites, tools, or services (“Third-Party Services”). These are provided solely for convenience. Yana does not control, endorse, or assume any responsibility for those Third-Party Services — including their content, availability, privacy policies, security, or any risk of harm. Your use of any Third-Party Services is at your own risk and subject to the separate terms and policies of those services.

10. Disclaimers of Warranties

THE PLATFORM AND ALL CONTENT PROVIDED ON IT ARE OFFERED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND—EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, YANA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND AVAILABILITY.

YANA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

11. Limitation of Liability

To the maximum extent permitted by applicable law, neither Yana nor its affiliates, officers, employees, agents, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, punitive, or loss-of-profits damages arising out of, or relating to: (i) your use of (or inability to use) the Platform; (ii) the services of any Provider; (iii) User Content; (iv) any errors or omissions in the Platform; (v) any unauthorized access to or alteration of your data; or (vi) any other matter relating to the Platform or these Terms, even if Yana has been advised of the possibility of such damages.

In jurisdictions or as required by applicable law, Yana’s total aggregate liability to you for all claims arising under these Terms will not exceed the greater of (a) the amount you paid to Yana in the six (6) months prior to the claim; or (b) a nominal amount such as USD $100 (or equivalent).

All Providers remain solely responsible for their services, professional decisions, and any outcomes.

12. Indemnification

You agree to defend, indemnify, and hold harmless Yana, its affiliates, officers, directors, employees, agents, and suppliers from and against all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys' fees) arising from or related to:

Your use of the Platform;
Your User Content;
Your interactions or agreements with any Provider; or
Your violation of these Terms or applicable law.

13. Prohibited Uses

You agree not to use the Platform for any unlawful, harmful, or fraudulent purpose. Prohibited uses include, but are not limited to:

Harassment, hate speech, or defamation;
Spam, fake reviews, or misleading content;
Use of automated tools (bots, scraping, crawlers) to harvest data from the Platform without our prior written consent;
Interfering with or attempting to circumvent the security or operations of the Platform;
Uploading viruses, malware or any harmful code.

14. Changes to Terms

We may revise these Terms at any time. Whenever we do, we will update the “Last Updated” date at the top. If we make material changes, we may also provide additional notice (e.g., by email or banner notification). Your continued use of the Platform after the revised Terms are posted will constitute acceptance of the changes.

15. Governing Law & Dispute Resolution

These Terms will be governed by the laws of the jurisdiction in which Yana is formally registered, once established. Any dispute arising out of or relating to these Terms or the Platform will be resolved in Alberta, Canada.

Where permitted by law, you and Yana agree to submit to binding arbitration in lieu of court litigation and waive any right to participate in class-actions or representative proceedings.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Miscellaneous

These Terms (together with the referenced Privacy Policy) constitute the entire agreement between you and Yana concerning your use of the Platform and supersede all prior agreements or communications. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. The headings in these Terms are for convenience only and do not affect interpretation.
